نحو معيار لتكييف عقود المالية الإسلامية: عقد التأمين التعاوني أنموذجا

Abstract

يسعى هذا البحث إلى ضبط معيار التكييف الفقهي للعقود المالية، وبيان أسسه التي تكون بمثابة مقاييس ومؤشرات متى تحققت بشروطها حُكم بحصول التكييف الفقهي، مع محاولة تطبيق ذلك المعيار في نقد تكييف عقد التأمين التعاوني الذي تم انتخابه أنموذجا للعقود المعاصرة. ويركز البحث على توظيف النظرة العامة للتشريع الإسلامي في مبادئه العامة ومقاصده خاصة المالية منها، ومراعاة دائرة الإباحة التي هي الأصل في التشريع الإسلامي. وقد استعان الباحث بالمنهج الاستقرائي لاستجلاء حقيقة التكييف الفقهي اعتمادا على المحاولات السابقة، وتجميع آراء الفقهاء القدامى والمعاصرين المتعلقة بالتكييف الفقهي، والمنهج التحليلي المقارن لتفكيك مستندات أبعاد التكييف وبيان مضامينها والمقارنة فيما بينها، والمنهج النقدي لبيان ما يقوي آراء الفقهاء والباحثين وما قد يؤخذ عليها سواء في عملية التكييف الفقهي أو في عقد التأمين الذي تم اختياره نموذجا تطبيقيا للبحث. وخلص الباحث إلى أن التكييف الفقهي لعقود المالية الإسلامية تستدعيه ضرورة قياس المعاملات المالية المستجدة إلى المعاملات المالية التي عرفها الفقه الإسلامي، كما بين الباحث أن دائرة الإباحة تقتضي الاستجابة للتطور في التعاملات المالية وعدم تكلف تكييفات لا تتحقق فيها ضوابط التكييف الفقهي بأبعاده الثلاثة التي حددها البحث: الشكلي (الهيكلي) المعني بالمقارنة في أطراف العقد وأركانه، والبعد الموضوعي المعني بالمقارنة في ماهية العقد وحقيقته، والبعد المقاصدي المعني بالمقارنة بين مقاصد أطراف العقد الناشئ من جهة ومقاصد أطراف العقود المسماة من جهة أخرى. ومن أهم نتائج هذا البحث أيضا أن عقد التأمين التكافلي لا صورة له سابقة يكيف عليها، وما ذهب إليه الفقهاء من تكييف عقد التأمين بأنه عقد تبرع لا يستجيب لمعيار التكييف الفقهي الذي تم التأسيس له.

This research strives to establish a rigorous standard for the classification of financial contracts from the view of Islamic jurisprudence (takyif fiqhi). It does so by clarifying the foundations of the process, which serve as its criteria and indicators. When they are realized with all their conditions, it can be said that the takyif fiqhi has been achieved. The research then attempts to apply this standard to a critique of the takyif fiqhi of the cooperative insurance contract, which was chosen as a sample contemporary contract. The research employs an overview of the Shari‘ah comprised of its general principles and its specific objectives regarding wealth, while giving due consideration to the domain of permissibility, which is the starting presumption of Islamic legislation. The researcher uses an inductive methodology in order to clarify the true nature of takyif fiqhi by relying on previous efforts, gathering the opinions of classical and contemporary scholars on the issue of takyif fiqhi. He also uses a comparative analytical methodology to deconstruct the bases of the characterization process and to clarify and compare their contents. It uses a critical methodology to explain what considerations strengthen the opinions of jurists and researchers and on what bases they can be criticized. This applies to the process of takyif fiqhi in general as well as to the takyif fiqhi of the cooperative insurance contract, which was chosen as a practical example for this research. The researcher concludes that the takyif fiqhi of Islamic financial contracts call for, of necessity, referral of contemporary contracts back to the contracts known in classical Islamic jurisprudence. The researcher also explains that the domain of permissibility requires a positive response to the advancement of financial dealings and avoidance of artificial and strained takyif fiqhi missing the criteria of proper takyif fiqhi, which the researcher has identified as comprising three dimensions: the formal (structural) dimension, which compares the parties and essential elements of the contract; the subject-matter dimension, which is concerned with the essence and true nature of the contract, and the intentional dimension, which compares the objectives of the contracting parties with the objectives that the nominate contract was intended to realize. Another important conclusion of this research is that there is no previous contractual form that can be used as a model for classifying the cooperative insurance contract. Its characterization by contemporary scholars as a contract of voluntary charitable contribution does not meet the standard of takyif fiqhi established in this research.
