Shari'a objectives related to legitimate policy and its instruments = المقاصد المتعلقة بباب السياسة الشرعية ووسائلها

This research aims at determining the specific objectives of Shariah, related to Shariah-based policy (al-siyasah al-Shar’iah), establishing its foundations and the most important means to realize these objectives in Islamic political field. The core problematic question of this research is: what are the specific objectives of Shariah-based policy and the core means operationalizing them? The research employs the inductive methodology by compiling all evidences founding these maqasid including verses of the Quran, Hadiths of Prophet, and precedent scholarly works. It also uses descriptive and analytical methodology to analyze the direct and indirect evidences compiled. The research consists of an introduction, six sections and conclusion. The first section defines the specific Shari’a objectives related to Shariah-based policy and precedent contributions in identifying them. Section two discusses the objective of justice establishment and its means. Section three elaborate on the objective of freedom and its means. Section four examines the objective of security and its means, section five discusses the objectives of development and its means. Section six stresses on the original and core objective of Shariah-based policy. The main finding of research is the confirmation that the core objectives of Shariah-based policy consist of: Justice, Freedom, security and development. These four essential elements have their means to be achieved; however the core objective is to establish justice.
يسعى هذا البحث لتحديد المقاصد المتعلقة بباب السياسة الشرعية، والتأصيل لها، وبيان أهم وسائل تحقيقها. والسؤال الرئيس الذي يطرحه هو: ما المقاصد المتعلقة بباب السياسة الشرعية وما أهم وسائل تحقيقها؟ وقد استعان الباحث فيه بالمنهج الاستقرائي لاستقصاء الأدلة التي تؤصل لتلك المقاصد من خلال القرآن الكريم والسنة النبوية المشرفة، وتتبع الجهود السابقة في الموضوع، واستعان أيضا بالمنهج الوصفي التحليلي لدراسة تلك النصوص وتحليلها. ويتكون البحث من مقدمة وستة مباحث وخاتمة؛ المبحث الأول في بيان مفهوم المقاصد المتعلقة بباب السياسة والجهود السابقة لتحديدها، والثاني في مقصد إقامة العدل ووسائله، والثالث في مقصد الحرية ووسائله، والرابع في مقصد الأمن ووسائله، والخامس في مقصد العمران ووسائله، والأخير في المقصد الأصلي لباب السياسة الشرعية. وتوصل الباحث إلى نتائج مهمة أبرزها أن مقاصد السياسة الشرعية أربعة: إقامة العدل والحرية والأمن والعمران ولكل منها وسائل جاءت بها النصوص وذكرها الفقهاء عرضها الباحث مشفوعة بأدلتها. وأن المقصد الأصلي لهذا الباب هو مقصد إقامة العدل.
